These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Foundational Creations ("Company," "we," "us," or "our"), governing your access to and use of the LoveVerse application, website, and related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

• Photo collage video creation with generated songs
• Audio file downloads and sharing capabilities

3. Account Registration

3.1 Account Creation

To use certain features of the Service, you must create an account. You may register using Google Sign-In, Apple Sign-In, or other authentication methods we provide. You agree to:

• Accept responsibility for all activities under your account

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store such content solely for the purpose of providing the Service.

4.2 Prohibited Content

You agree not to submit content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
• Infringes on intellectual property rights of others
• Contains explicit sexual content or promotes violence
• Impersonates any person or entity
• Contains malicious code, viruses, or harmful data
• Violates any applicable laws or regulations

4.3 Content Moderation

We reserve the right to review, modify, or remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

5. Intellectual Property

5.1 Our Intellectual Property

The Service, including its design, features, functionality, and content (excluding User Content), is owned by Foundational Creations and protected by copyright, trademark, and other intellectual property laws.

5.2 Generated Content Ownership

Songs, lyrics, and other content generated through the Service ("Generated Content") are provided to you under a license that depends on your subscription tier:

• Free/Single Song: Personal, non-commercial use license
• Couple's Pack: Personal use with limited sharing rights
• Premium: Commercial use license for Generated Content

5.3 AI-Generated Content Disclaimer

Generated Content is created using artificial intelligence and machine learning models. While we strive for originality, we cannot guarantee that Generated Content is entirely unique or free from similarities to existing works.

6. Payments and Subscriptions

6.1 Pricing

We offer various pricing options including one-time purchases and subscription plans. All prices are displayed in the applicable currency and are subject to change with notice.

6.2 Payment Processing

Payments are processed through third-party payment providers (including Apple App Store, Google Play Store, and RevenueCat). You agree to their respective terms of service.

6.3 Refund Policy

We offer a 30-day money-back guarantee on all purchases. If you are not satisfied with the Service, contact us at support@foundationalcreations.com within 30 days of purchase for a full refund. Refunds for app store purchases must be requested through the respective app store.

6.4 Subscription Cancellation

You may cancel your subscription at any time through your account settings or the respective app store. Cancellation takes effect at the end of the current billing period.

7. Disclaimers and Limitations

7.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.2 Limitation of Liability

To the maximum extent permitted by law, Foundational Creations shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

7.3 Maximum Liability

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Foundational Creations, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Upon termination, your right to use the Service will immediately cease, but provisions that by their nature should survive will remain in effect.

10. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

10.2 Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. You agree to waive any right to a jury trial or to participate in a class action.
