End User License Agreement (EULA)

1. Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Foundational Creations ("Licensor," "we," "us," or "our") for the use of the LoveVerse mobile application, web application, and related services (collectively, the "Application").

By downloading, installing, or using the Application, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not use the Application.

2. License Grant

2.1 Limited License

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Application on devices you own or control
• Access and use the Application for personal, non-commercial purposes
• Create, download, and share content generated through the Application

2.2 License Restrictions

You may not:

• Copy, modify, or create derivative works of the Application
• Reverse engineer, decompile, or disassemble the Application
• Remove or alter any proprietary notices or labels
• Use the Application for any unlawful purpose
• Rent, lease, lend, sell, or sublicense the Application
• Use automated systems to access the Application
• Circumvent any technological measures protecting the Application
• Use the Application to infringe on others' intellectual property rights

3. Content License

3.1 User Content

You retain ownership of stories, descriptions, and other content you provide ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store such content to provide the Service.

3.2 Generated Content License

Songs, lyrics, music, and videos created through the Application ("Generated Content") are licensed to you based on your subscription:

• Free/Single Song: Personal use only. You may share on social media with attribution to LoveVerse. Commercial use is prohibited.
• Couple's Pack: Personal use with enhanced sharing rights. You may use at personal events (weddings, anniversaries). Commercial use is prohibited.
• Premium: Commercial use permitted. You may use Generated Content in monetized projects, performances, and commercial productions.

3.3 Attribution

For non-commercial use, we appreciate (but do not require) attribution to LoveVerse by Foundational Creations when sharing Generated Content publicly.

4. Intellectual Property

4.1 Application Ownership

The Application, including all code, designs, graphics, interfaces, and documentation, is owned by Foundational Creations and protected by intellectual property laws. This EULA grants you no ownership rights in the Application.

4.2 AI Models

The artificial intelligence and machine learning models used to generate content are proprietary to Foundational Creations and our third-party providers. You acquire no rights in these models.

4.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the Application may be used by us without obligation or compensation to you.

5. Third-Party Services

The Application integrates with third-party services including:

• Authentication: Google, Apple Sign-In services
• AI Services: OpenAI, Anthropic, ElevenLabs
• Payment Processing: RevenueCat, App Store, Google Play
• Cloud Services: Google Cloud, Cloudflare

Your use of these services is subject to their respective terms and conditions. We are not responsible for third-party services.

6. Subscriptions and Payments

6.1 Subscription Terms

Paid features require purchase of credits or subscription plans. Subscriptions automatically renew unless cancelled before the renewal date.

6.2 Pricing

Prices are subject to change. Price changes do not affect active subscription periods but will apply to renewals.

6.3 Refunds

We offer a 30-day money-back guarantee. Refund requests for app store purchases must be submitted through the respective app store. Contact support@foundationalcreations.com for web purchases.

7. Privacy

Your use of the Application is subject to our Privacy Policy, which describes how we collect, use, and protect your information. By using the Application, you consent to our data practices as described in the Privacy Policy.

8. Disclaimers

8.1 No Warranty

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 AI-Generated Content

Content generated by AI may contain errors, inaccuracies, or unintended similarities to existing works. We do not guarantee the accuracy, quality, or originality of Generated Content.

8.3 Service Availability

We do not guarantee uninterrupted, secure, or error-free operation of the Application. Service may be interrupted for maintenance, updates, or circumstances beyond our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUNDATIONAL CREATIONS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from use or inability to use the Application
• Third-party claims against you

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Foundational Creations, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Application
• Your User Content
• Your violation of this EULA
• Your violation of any third-party rights

11. Termination

11.1 By You

You may terminate this EULA by uninstalling the Application and deleting your account.

11.2 By Us

We may terminate or suspend your license immediately, without notice, for any violation of this EULA or for any other reason at our sole discretion.

11.3 Effect of Termination

Upon termination, your license to use the Application ends. Sections regarding intellectual property, disclaimers, limitations, and indemnification survive termination.

12. Updates and Modifications

We may update the Application and this EULA from time to time. Continued use after updates constitutes acceptance of changes. We will notify you of material changes through the Application or by email.

13. Governing Law

This EULA is governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
